Terms of Service
1. Agreement to Terms
By accessing or using PaceFyndr (the "App"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this application.
These Terms constitute a legally binding agreement between you and PaceFyndr ("we," "our," or "us"). Please read them carefully before using the App.
2. Eligibility
To use PaceFyndr, you must:
- Be at least 13 years of age (or 16 in the European Economic Area)
- Have the legal capacity to enter into these Terms
- Not be barred from using the App under applicable law
- Not have had your account previously terminated for violations
3. License and Restrictions
License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use PaceFyndr for personal, non-commercial purposes, subject to these Terms.
You Agree NOT To:
- Modify, copy, distribute, or create derivative works of the App
- Reverse engineer, decompile, or disassemble any software in the App
- Use the App for any commercial purpose without authorization
- Remove any copyright, trademark, or proprietary notices
- Use automated systems (bots, scrapers) to access the App
- Attempt to gain unauthorized access to any systems or data
- Upload viruses, malware, or any malicious code
- Interfere with the proper functioning of the App
- Use the App in any manner that violates applicable laws
4. User Accounts
When you create an account with us, you must provide accurate, complete, and current information at all times. You are responsible for:
- Maintaining the confidentiality of your account password
- All activities that occur under your account
- Restricting access to your device to prevent unauthorized use
- Notifying us immediately of any suspected unauthorized use or security breach
- Ensuring your account information remains accurate and up-to-date
Important
We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion if we believe there has been a violation of these Terms.
5. Community Guidelines
PaceFyndr is a community platform built on mutual respect and safety. All users must adhere to our community standards. Violation of these guidelines may result in content removal, account suspension, or permanent termination.
Prohibited Conduct:
- Harassment, bullying, or intimidation of other users
- Hate speech, discrimination, or offensive content
- Impersonation or creation of fake accounts
- Spam, phishing, or commercial solicitation
- Sexual content or inappropriate advances
- Sharing others' private information without consent
- Promoting violence, illegal activities, or self-harm
- Intellectual property violations or copyright infringement
- Posting false or misleading information about events
- Using the App to sell goods or services without authorization
Reporting Violations: If you encounter content or behavior that violates these guidelines, please report it immediately through the App's reporting feature or by emailing support@pacefyndr.com.
6. User Content
Your Content
You retain all rights to the content you post on PaceFyndr ("User Content"), including photos, posts, comments, and event descriptions. However, by posting content, you grant us:
- A worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating the App
- The right to show your User Content to other users within the App's features
- The right to use your User Content for promotional purposes (with your separate consent)
Content Standards
You represent and warrant that your User Content:
- Does not violate any third-party rights (copyright, trademark, privacy, publicity)
- Is accurate and not misleading
- Does not contain malicious code or viruses
- Complies with all applicable laws and regulations
Content Moderation: We reserve the right (but have no obligation) to monitor, review, and remove User Content that violates these Terms or is otherwise objectionable. We are not responsible for User Content posted by others.
7. Fitness & Safety Disclaimer
PaceFyndr facilitates connections between runners and provides tools for organizing fitness activities. However:
- We do NOT organize, supervise, or verify the safety of any events or meetings
- We do NOT conduct background checks on users
- We do NOT guarantee the accuracy of user-provided information
- Physical activity carries inherent risks of injury or harm
Safety Recommendations
- ✓Always meet in public, well-lit locations
- ✓Inform a friend or family member of your plans
- ✓Bring a charged mobile phone with you
- ✓Trust your instincts and leave if you feel unsafe
- ✓Consult a physician before starting any fitness program
- ✓Stay hydrated and know your physical limits
YOU ASSUME ALL RISKS associated with using PaceFyndr and participating in any activities organized through the App. You are solely responsible for your own safety and the safety of others.
8. Organizers & Hosts
If you create, host, or list events, run clubs, or other activities on PaceFyndr ("Host"), you are subject to additional responsibilities and liabilities.
You must review and agree to our separate Host Terms & Conditions, which are incorporated by reference into these Terms.

PaceFyndr may integrate with Apple Health and display fitness metrics (pace, distance, heart rate, etc.). This data is for informational purposes only and should NOT be used for medical diagnosis or treatment.
- PaceFyndr is NOT a medical device or health monitoring system
- Data accuracy depends on your device sensors and may contain errors
- Do not rely solely on the App for health or fitness decisions
- Consult a qualified healthcare provider for medical advice
- If you experience chest pain, dizziness, or shortness of breath, seek immediate medical attention
10. Subscriptions & Payments
PaceFyndr may offer premium features through in-app subscriptions managed by RevenueCat and processed through the Apple App Store or Google Play Store.
Subscription Terms:
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Payment is charged to your Apple ID or Google Play account at confirmation of purchase
- You can manage or cancel subscriptions in your device's account settings
- Refunds are subject to Apple's or Google's refund policies
- Prices may change with 30 days' notice; existing subscribers retain current pricing until renewal
- Canceling a subscription does not entitle you to a prorated refund
Free Trials: If a free trial is offered, you will be charged the subscription price when the trial ends unless you cancel before the trial period expires.
11. Intellectual Property
The App and all content (excluding User Content), features, and functionality are owned by PaceFyndr and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
"PaceFyndr" and all related logos, trademarks, and service marks are the property of PaceFyndr. You may not use these marks without our prior written permission.
12. Third-Party Services
PaceFyndr integrates with third-party services including Mapbox, Apple Health, Supabase, Cloudinary, OneSignal, and others. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the content, functionality, or practices of these third-party services.
Links to external websites are provided for convenience only and do not constitute an endorsement.
13. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
To the fullest extent permitted by law, PaceFyndr disclaims all warranties, express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties regarding accuracy, reliability, or availability of the App
- Warranties that the App will be uninterrupted, secure, or error-free
- Warranties regarding the quality, safety, or legality of User Content
- Warranties that defects will be corrected or that the App is free of viruses
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACEFYNDR SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE APP.
This includes, without limitation:
- Direct, indirect, incidental, or consequential damages
- Loss of profits, revenue, data, or goodwill
- Personal injury or property damage
- Damage resulting from unauthorized access to your account
- Damage resulting from User Content or conduct of other users
- Damage from interruption or unavailability of the App
- Damage from reliance on information in the App
- Damage from third-party services or content
Some jurisdictions do not allow limitation of liability for personal injury or incidental/consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless PaceFyndr and its officers, directors, employees, contractors, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Your User Content
- Your conduct in connection with the App or events
16. Termination
We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination:
- Your right to use the App will immediately cease
- Your account and data may be deleted (subject to our data retention policies)
- You remain liable for any obligations incurred prior to termination
- Provisions that should survive termination (disclaimers, limitations, indemnification) will remain in effect
You may delete your account at any time through the App settings. Account deletion is permanent and cannot be reversed.
17. Binding Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Agreement to Arbitrate
You and PaceFyndr agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App will be settled by binding arbitration in accordance with the rules of the Cairo Regional Centre for International Commercial Arbitration (CRCICA), rather than in court, except that:
- Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the App
- Small claims may be filed in appropriate local courts
Class Action Waiver
YOU AGREE THAT DISPUTES WILL BE ARBITRATED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CLASS ARBITRATION, OR CONSOLIDATED ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Arbitration Procedures
- The arbitration will be conducted in English or Arabic
- The arbitrator's decision will be final and binding
- Each party will bear its own costs and attorneys' fees unless the arbitrator awards them to the prevailing party
- The arbitration will take place in Cairo, Egypt or via remote proceedings
You have the right to opt out of arbitration by sending written notice to legal@pacefyndr.com within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of the arbitration agreement.
18. Dispute Resolution & Governing Law
Governing Law
These Terms are governed by and construed in accordance with the laws of the Arab Republic of Egypt, without regard to conflict of law principles. For any disputes not subject to arbitration, you agree to submit to the jurisdiction of the courts located in Cairo, Egypt.
Informal Resolution
Before filing a claim or initiating arbitration, you agree to contact us at legal@pacefyndr.com and attempt to resolve the dispute informally. Provide a brief description of the dispute and your desired resolution. We will attempt to resolve the dispute within 30 days.
19. Force Majeure
We shall not be liable for any failure to perform due to causes beyond our reasonable control, including:
- Natural disasters (earthquakes, floods, severe weather)
- Pandemics, epidemics, or public health emergencies
- Government actions, orders, or regulations
- Acts of terrorism, war, or civil unrest
- Internet, telecommunications, or power failures
- Strikes or labor disputes
20. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App, via email, or through a prominent notice, and updating the "Effective Date" above.
Your continued use of the App after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the App.
21. Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy and Host Terms, constitute the entire agreement between you and PaceFyndr.
Severability
If any provision is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
Waiver
Our failure to enforce any right or provision does not waive that right or any other right.
Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
